Seibert v. Quest Diagnostics (Age Discrimination)

Employment and Labor Law in Morristown, NJOn November 18, 2010 Green Savits & Lenzo filed a class action against Quest Diagnostics. The Complaint, which is attached below, alleges that Quest Diagnostics violated the New Jersey Law Against Discrimination by discriminating against its employees based on their age. Theresa Seibert was an Account Service Representative and 26-year employee of Quest Diagnostics. In 2010, after many years of service without any problems,  she was terminated supposedly for poor performance. The Complaint alleges that her termination was part of a plan by Quest to create impossible standards for its older sales representatives to meet and then to terminate them once they could not meet those standards. The older sales representatives would then be replaced by younger, less experienced sales people who were not required to meet the same standards. Ms. Seibert is representing a class consisting of older sales representatives  and sales managers who were terminated by Quest over the last two years under similar circumstances.
