Jon Green Educates New Jersey’s Newest Attorneys on Workplace Discrimination and Retaliation

On June 16, 2025, Jon Green, a founding partner of the firm, was a featured speaker for the New Jersey Institute for Continuing Legal Education (NJICLE). The program, designed for newly admitted attorneys in New Jersey, focused on foundational legal knowledge, and Jon’s session tackled two critical areas of employment law: workplace discrimination and whistleblower retaliation.

In his presentation, “New Jersey Discrimination and Retaliation Overview,” Jon provided practical and statutory insights into how New Jersey protects employees - and what legal practitioners need to know as they begin their careers.

Understanding the NJ Law Against Discrimination (LAD)

One of the primary focus areas of Jon’s talk was the New Jersey Law Against Discrimination (LAD), a broad and powerful statute that prohibits employers from discriminating against employees or applicants based on a wide range of protected classes.

As Jon outlined, the LAD makes it unlawful for employers to:

  • Refuse to hire, employ, or promote;
  • Terminate or force retirement;
  • Discriminate in compensation, benefits, or other terms and conditions of employment;
  • Issue discriminatory job advertisements;
  • Treat pregnant or breastfeeding employees less favorably than others with similar work limitations.

These protections extend to individuals based on traits, including, but not limited to:

  • Age
  • Ancestry
  • Atypical hereditary cellular or blood trait (AHCBT)
  • Color
  • Creed
  • Disability or handicap
  • Gender identity or expression
  • Genetic information (including refusal to participate in genetic testing)
  • Marital status, civil union status, or domestic partnership
  • National origin and nationality

Jon also addressed employer obligations under these laws, providing attendees with a clear framework for identifying unlawful conduct and advocating for workers’ rights.

Whistleblower Protections Under CEPA

Another major theme of Jon’s presentation was the Conscientious Employee Protection Act (CEPA) - New Jersey’s whistleblower statute. CEPA provides legal protection to employees who report, object to, or refuse to participate in activities they believe to be illegal or unethical.

Jon walked new attorneys through the elements of a CEPA claim, employer defenses, and best practices for protecting both clients and their professional integrity in whistleblower cases.
