Pursuing an LGBT Discrimination Claim in New Jersey
Employees who believe they’ve experienced LGBT discrimination in New Jersey have two paths forward. The first is filing a complaint with the NJ Division on Civil Rights (DCR) within 180 days of the discriminatory act. If the DCR finds probable cause and the matter isn’t resolved, a hearing is held before the Office of Administrative Law, with the DCR Director issuing a final decision. The second path is filing a lawsuit directly in NJ Superior Court within two years of the discriminatory conduct.
Damages an Employee May Recover
If a claim succeeds, an employee may be entitled to recover lost wages, loss of earning capacity, front pay, reinstatement, compensation for emotional distress, loss of reputation, and attorneys’ fees and costs. When an employer’s conduct was malicious or in willful disregard of the employee’s rights, punitive damages may also be available. The DCR can additionally order policy changes to prevent future discrimination.
