What Counts as Religious Discrimination Under New Jersey Law

The New Jersey Law Against Discrimination (NJLAD) and Title VII of the Civil Rights Act of 1964 both prohibit employers from treating workers unfavorably because of their religious beliefs, practices, or lack of belief. NJLAD covers an unusually broad range of protected beliefs, including major faiths, smaller or nontraditional religions, atheism, and moral or ethical belief systems that function like religious convictions. It also protects employees targeted because of their relationship with someone of a particular faith, or based on perceived religious identity.

Prohibited employer conduct includes refusing to hire, terminating, demoting, cutting pay or hours, and denying promotions on the basis of religion. Employers also can’t ask applicants about their religious beliefs, practices, or affiliations during the hiring process. One important distinction: Title VII applies only to employers with 15 or more employees, while NJLAD applies to employers of all sizes in New Jersey.

Harassment based on religion is also unlawful when it’s severe or pervasive enough to create a hostile work environment. That includes religious slurs, mocking of religious dress or practices, and discriminatory scheduling around religious observances. Religious discrimination often overlaps with national origin or ancestry discrimination. Bias directed at a Jewish, Muslim, or Sikh employee, for example, can give rise to claims under multiple protected categories at once.
